1. Agreement to Terms

By accessing and using the CIC-ATT&CK platform (the "Platform"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform. The Institute for Critical Infrastructure Cybersecurity (ICIC) reserves the right to modify these terms at any time. Your continued use of the Platform following such modifications constitutes your acceptance of the updated terms.

2. Use License

ICIC grants you a limited, non-exclusive, non-transferable license to access and use the Platform for lawful purposes. You agree not to:

• Reproduce, distribute, or transmit content without authorization
• Modify, translate, or create derivative works of the Platform
• Reverse engineer, decompile, or disassemble the Platform
• Use the Platform for commercial purposes without explicit permission
• Attempt to gain unauthorized access to the Platform or its systems
• Interfere with or disrupt the Platform's operation or servers
• Use automated tools, bots, or scrapers to access the Platform
• Engage in any illegal or harmful activities

3. Intellectual Property Rights

The Platform, including all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio), is owned by ICIC, its licensors, or other providers of such material and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited license to view and use the Platform for personal, non-commercial purposes only.

The MITRE ATT&CK framework is used under license from MITRE Corporation. All references to ATT&CK techniques, tactics, and procedures are based on the MITRE ATT&CK framework and are subject to MITRE's terms and conditions.

4. User-Generated Content

If you submit any content to the Platform (including comments, feedback, or suggestions), you grant ICIC a worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, and distribute such content. You represent and warrant that you own or have the necessary rights to grant this license and that your content does not infringe upon any third-party intellectual property rights.

5. Disclaimer of Warranties

The Platform is provided on an "as-is" and "as-available" basis. ICIC makes no warranties, express or implied, regarding the Platform, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. ICIC does not warrant that the Platform will be uninterrupted, error-free, or secure.

6. Limitation of Liability

To the fullest extent permitted by law, ICIC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if ICIC has been advised of the possibility of such damages. In no event shall ICIC's total liability exceed the amount paid by you, if any, for accessing the Platform.

7. Indemnification

You agree to indemnify, defend, and hold harmless ICIC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, violation of these Terms of Use, or infringement of any third-party rights.

8. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Harassing, threatening, or abusing other users
• Posting obscene, defamatory, or libelous content
• Transmitting viruses, malware, or other harmful code
• Spamming or sending unsolicited communications
• Impersonating another person or entity
• Violating any applicable laws or regulations
• Engaging in any form of fraud or deception

9. Termination

ICIC reserves the right to terminate or suspend your access to the Platform at any time, with or without cause, and without notice. Upon termination, your right to use the Platform will immediately cease. ICIC may also delete your account and any associated data.

10. Third-Party Links and Content

The Platform may contain links to third-party websites and content. ICIC is not responsible for the availability, accuracy, or content of such external sites. Your use of third-party websites is governed by their terms of use and privacy policies.

11. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the federal and state courts located in the United States for the resolution of any disputes arising from these terms or your use of the Platform.

12. Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

These Terms of Use, together with our Privacy Policy and any other policies posted on the Platform, constitute the entire agreement between you and ICIC regarding your use of the Platform and supersede all prior and contemporaneous agreements, understandings, and negotiations.
